Sexual Harassment
In Florida, in addition to the Federal laws, there is the Florida Civil Rights Act of 1992. This Act secures freedom from discrimination because of race, color, religion, sex, national origin, age, handicap, or marital status and protect an individual’s interest in personal dignity.
The following conduct is generally considered sexual harassment: a) direct sexual conduct or advances, b) quid pro quo, when job related benefits are offered in exchange for sexual conduct, and c) hostile work environment, when the employer maintains an overly sexual work environment.
Florida sexual harassment usually is seen as a male superior requesting sexual favors from a female employee. But, there is nothing that says it can’t be a female superior and male employee or even a male and male or female and female type situation. In any of the above four situations, the employee is always at a disadvantage because he or she knows that if he or she does not comply with the sexual harassment, that he or she will suffer adverse actions such as not being given a promotion, or a reduction in the employee’s salary, or even termination.
The hostile work environment situation is usually when the coworkers put up offensive sexual images, there is a lot of physical touching, pornographic emails are being sent to other employees or sexual jokes or acts are constantly being committed during the work day and the employer does nothing to prohibit it.
In a Florida sexual harassment scenario, the woman usually suffers and a stone wall is put up so as to protect the employer or supervisor. Our firm will fight for you and break down that wall to get you the best recovery we can for the personal injuries that you have suffered as a result of someone else’s ignorance and intolerance.
