Religious Discrimination

Title VII of the Civil Rights Act of 1964 prohibits discrimination based on ones’ religious beliefs. In fact, the Act also requires that employers reasonably accommodate the religious practices of an employee unless to do so would create an undue hardship upon the employer. It has been held that employer must allow flexible scheduling, voluntary substitutions or swaps, job reassignments or later transfers to accommodate an employee’s religious beliefs.

Further, employers cannot schedule examinations or other important activities in conflict with an employee’s religious needs; such as making a certain test only on the Sabbath or religious holiday.
